This was bound to happen sooner or later. I suppose it happened sooner – Hermès filed a lawsuit against the small accessories company, Thursday Friday, who are responsible for selling that Hermès Birkin Bag canvas tote. Thursday Friday – the lawsuit papers that WWD dug up say – seeked to “take unfair advantage of the fame and reputation of the Birkin Bag.”
The Birkin Bag canvas tote was immediate viral hit when it quietly launched last year. At $35 a tote, you needed to be on a few months waiting list to get one.
While huge company vs. little guy narrative comes to mind, one mustn’t forget that Hermès are indeed the ones in the right here. The Birkin Bag is Hermès’s intellectual property and while there’s no way one would confuse the canvas tote with the real thing, the only reason one would buy the tote was in fact due to the Birkin print on it.
